1. INTRODUCTION

These Terms & Conditions govern the use of www.mysportaddiction.co.za and all purchases of products and services from My Sport Addiction (PTY) Ltd (“the Company”).

By placing an order, you agree to be legally bound by these Terms & Conditions.

2. PRODUCTS & SERVICES

We specialise in:

  • Custom printed apparel
  • Personalised sporting garments
  • Teamwear and bulk orders
  • Branded merchandise
  • Design and branding services

All custom items are manufactured according to the specifications approved by the customer.

3. ORDER ACCEPTANCE

An order is only confirmed once:

  • Full payment has been received, or
  • A deposit has been received where agreed, and
  • Written design approval has been provided.

We reserve the right to decline or cancel orders at our discretion.

4. PRICING & PAYMENT

All prices are listed in South African Rand (ZAR).

Payments are processed securely via:

PayFast

We do not store credit card details.

Orders will not enter production until payment has cleared.

5. CUSTOM-MADE GOODS (CPA COMPLIANCE)

In accordance with Section 16(4)(b) of the Consumer Protection Act 68 of 2008:

The 7-day cooling-off period does not apply to:

  • Custom-made goods
  • Personalised products
  • Specially ordered items
  • Bulk team orders manufactured to specification

Once production has commenced, custom orders cannot be cancelled, returned, or refunded unless defective under Section 56 of the CPA.

6. ARTWORK & DESIGN APPROVAL

The customer is solely responsible for:

  • Correct spelling
  • Names and numbers
  • Sizing selections
  • Colour confirmation
  • Logo placement approval

Once final artwork approval is provided (email or written confirmation):

  • The Company is not liable for approved errors.
  • Production proceeds based on approved artwork.

Proof of approval will be retained for record purposes.

7. SIZING DISCLAIMER

Customers are responsible for consulting size charts prior to ordering.

Custom garments cannot be exchanged due to incorrect sizes selected by the customer.

We are not liable for fit preferences.

8. COLOUR VARIATION DISCLAIMER

Due to differences in:

  • Screen displays
  • Fabric batches
  • Printing processes

Slight colour variations may occur.

Such variations do not constitute defects under the CPA.

9. PRODUCTION TIMEFRAMES

Production timelines:

  • Begin once payment and artwork approval are received.
  • Are estimates only and not guaranteed delivery dates.

We are not liable for delays caused by:

  • Courier companies
  • Supplier delays
  • Force majeure events
  • Load shedding or infrastructure interruptions

10. DELIVERY & RISK

Risk passes to the customer upon:

  • Collection, or
  • Handover to the courier company.

Customers must inspect goods upon delivery.

Damage in transit must be reported within 48 hours.

11. DEFECTIVE GOODS (SECTION 56 CPA)

If a product is defective within 6 months of delivery, the customer may request:

  • Repair
  • Replacement
  • Refund

Provided that:

  • The product has not been misused
  • Washing instructions were followed
  • The defect is manufacturing-related

Normal wear and tear does not qualify.

12. CARE INSTRUCTIONS

Failure to follow garment care instructions may void any defect claims.

We recommend:

  • Cold wash
  • Inside-out washing
  • No tumble drying
  • No direct ironing on prints

13. INTELLECTUAL PROPERTY

All:

  • Designs
  • Mockups
  • Artwork
  • Website content

Remain the property of My Sport Addiction (PTY) Ltd unless otherwise agreed in writing.

Customers warrant that they have the legal right to use any logos or trademarks submitted for printing.

The Company is not liable for trademark infringement resulting from customer-submitted artwork.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

My Sport Addiction (PTY) Ltd shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits
  • Business interruption
  • Missed event deadlines
  • Courier delays
  • Incorrect information supplied by the customer

Total liability shall not exceed the amount paid for the specific order.

15. FORCE MAJEURE

We shall not be liable for failure to perform due to circumstances beyond our control, including but not limited to:

  • Natural disasters
  • Strikes
  • Power outages
  • Government restrictions
  • Civil unrest

16. WEBSITE USE

This website operates using:

WooCommerce

We do not guarantee uninterrupted website access.

Users may not:

  • Attempt unauthorised access
  • Introduce malicious code
  • Copy website content without permission

17. PRIVACY
